This request was evaluated by Red Hat Product Management for inclusion in a Red
Hat Enterprise Linux maintenance release.  Product Management has requested
further review of this request by Red Hat Engineering, for potential
inclusion in a Red Hat Enterprise Linux Update release for currently deployed
products.  This request is not yet committed for inclusion in an Update
release.

can reproduced on rhel5-u5:
[root@amd-ma78gm-02 mnt]# ls -l
total 0
-rwxrwSrwx 1 root root 1528 Oct 21  2010 aa
drwxrwxrwx 2 root root    0 Oct 21  2010 done
[root@amd-ma78gm-02 mnt]# mv aa done/bb
[root@amd-ma78gm-02 mnt]# ls -l
total 4
-rwxrwSrwx 1 root root 2512 Oct 21  2010 bb
drwxrwxrwx 1 root root    0 Oct 21  2010 done
[root@amd-ma78gm-02 mnt]# ls -l done/
total 0

verified on RHEL5.6-Server-20101014.0 on i386 and x86_64:
# mv aa done/bb
mv: cannot move `aa' to `done/bb': Text file busy
# uname -a
Linux dell-t5500-01.lab.bos.redhat.com 2.6.18-227.el5 #1 SMP Tue Oct 12 18:50:50 EDT 2010 x86_64 x86_64 x86_64 GNU/Linux
