I think this is actually a problem for all mounts in one way or another, not only /tmp, and also for /tmp not just when tmpfs is used. I think the right approach is to warn the user in all cases where we over-mount a non-empty directory. I have now changed systemd git (will enter F18 soon) to warn when we over-mount a non-empty directory.
