The problem is not present in 4.3 GA IR2
We're using OracleDialect here, which is the suggested default (http://www.hibernate.org/hib_docs/reference/en/html/session-configuration.html). Possibly a hibernate change may have fixed this.
Closing - cannot recreate problem in 4.3, IR2.
