I think this is fixed with this patch.

I think the latest kernel update (3.10.9-200.fc19.x86_64) might of made things worse, I am now receiving the error every few minutes.

It has.  The upstream developer said:

"since frto=0 didn't help, I suspect it's either a bug introduced in
the tail loss probe patch 9b717a8d (tcp: TLP loss detection) or other
changes related loss recovery.

could you try disable TLP by
sysctl net.ipv4.tcp_frto=0 net.ipv4.tcp_early_retrans=1

if it still does not work. disable any form of early retransmit by
sysctl net.ipv4.tcp_frto=0 net.ipv4.tcp_early_retrans=0"

Please try those steps and let us know what you see.

There is also a debug patch provided and I will get a scratch build done tomorrow with that included.

Fedora 19 has now been rebased to 3.11.1-200.fc19.  Please test this kernel update and let us know if you issue has been resolved or if it is still present with the newer kernel.

Setting net.ipv4.tcp_early_retrans=1 made my VPN connection stop working.

Connection finished, but I couldn't pin through the VPN, so I went back to the value of 3.
